Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") are a binding agreement between you and Mindantic LLC ("Mindantic", "ShotMark", "we", "us", or "our"), a limited liability company based in Missouri, United States. They govern your use of the ShotMark website at shotmark.dev and everything we offer through it, the waitlist, newsletter, blog, and free tools (together, the "Services"). By using the Services, you agree to these Terms; if you don't agree, please don't use the Services.

2. Who can use the Services

You must be at least 16 years old, or the age of digital consent in your country, to use the Services. By using them, you confirm that you meet this requirement and that any information you give us is accurate.

3. The Services (pre-launch)

ShotMark is in active development. The Services are provided on an "as-is" and "as-available" basis, and features, content, and availability may change or be removed at any time without notice. Joining the waitlist does not guarantee access, specific pricing, or a launch date.

4. Free tools

Our free tools, such as the JSON formatter, HAR viewer, and JWT decoder, run in your browser and are offered for convenience, without warranty. You are responsible for the data you process with them and for keeping your own backups. Please don't rely on them for anything safety- or compliance-critical.

5. Newsletter and waitlist

By subscribing, you consent to receive periodic emails about ShotMark, QA, and bug reporting. You can unsubscribe at any time using the link in any email.

6. Acceptable use

When using the Services, you agree not to:

• Break the law or infringe anyone's rights.
• Disrupt, overload, scrape, or attempt to gain unauthorised access to the Services or our systems.
• Reverse engineer or interfere with the site, except where the law expressly permits it.
• Use the Services to transmit malware or harmful content.

7. Intellectual property

The ShotMark name, logo, site, and original content are owned by ShotMark and protected by intellectual-property laws. Our blog posts, guides, and templates are provided for your personal and internal business use; you may use our templates in your own work, but you may not republish or redistribute our content as your own without permission.

8. Your submissions

If you send us feedback, ideas, or messages, for example through the contact form, you grant us a non-exclusive, royalty-free right to use them to operate and improve ShotMark, with no obligation to you. Please don't send us anything confidential that you don't want us to use.

9. Third-party links

The Services may link to third-party sites or tools we don't control. We are not responsible for their content, policies, or practices, and a link does not imply endorsement.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, Mindantic LLC and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to your use of the Services. Our total liability for any claim will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the claim, which, while the Services are free, is USD 0, or (b) USD 100.

Some jurisdictions don't allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold ShotMark harmless from any claims, damages, or expenses arising out of your misuse of the Services or your violation of these Terms.

13. Changes and termination

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms; when we do, we'll revise the "last updated" date above, and your continued use of the Services means you accept the changes.

14. Governing law

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Missouri, unless mandatory consumer-protection law in your country of residence gives you the right to bring a claim elsewhere.
